On This Day Challenge Rules and Regulations

1. DESCRIPTION OF THE CHALLENGE: The On This Day Challenge (the “Challenge”) is designed to help students (1) learn to find and evaluate quality Web sites for online history research, (2) learn how to organize and write a research article about historical events and (3) gain an appreciation of how historical events have shaped the world.

2. PRIZES: The schools, classrooms and students participating in the challenge will have the opportunity to win prizes. Judges will choose winning Entries (each, an “Entry”) in accordance with these Official Rules and prizes will be awarded to eligible winning participants (”Participants”).

3. SPONSORS: The Challenge is sponsored by Dulcinea Media, Inc. (DM), Brooklyn, N.Y. (Sponsor).

4. BINDING AGREEMENT: In order to enter the Challenge, you must agree to these Official Rules (”Rules”). Therefore, please read these Rules before entry to ensure you understand and agree. You agree that submission of an Entry in the Challenge constitutes agreement to be bound by these Rules. You may not submit an Entry to the Challenge and are not eligible to receive the prizes described in these Rules unless you agree to these Rules. These Rules form a binding legal agreement between you and the Sponsors with respect to the Challenge.

5. ELIGIBILITY: For purposes of awarding prizes, the Challenge is open to individuals or teams of current elementary school, middle school or high school students (including students who are home schooled), except the employees of the Sponsor and members of their immediate families, who have agreed to these Rules. Participants under 18 years of age must demonstrate the consent of a parent or legal guardian in order to be eligible to receive any prizes.

6. CHALLENGE PERIOD: For purposes of the awarding of prizes for the 2010-2011 school year, the Challenge begins at 12:01 a.m. Eastern Time on Sept. 1, 2010, and ends at 11:59 p.m. Eastern Time on May 15, 2011 (”Challenge Period”).

7. SUBMISSION OF ENTRIES: In order to submit an Entry to the Challenge, students must submit an Entry through the account of a teacher, librarian or other sponsoring educator on the Web site located at http://findingEducation.com. Alternatively, the educator may post the article to any other Web site or blog that is publicly available on the Internet, with a note that the article is an entry in findingEducation’s On This Day Challenge, and a hyperlink to the Challenge Home page, here: http://findingeducation.com/on-this-day-challenge/ and to the findingDulcinea On This Day feature. If the alternative entry method is chosen, the educator must email to info@DulcineaMedia.com a link to the page where the article is posted. Submission of entries is more particularly described at http://findingeducation.com/on-this-day-challenge/.

8. JUDGING: Each Entry will be judged by members of the editorial staff of Dulcinea Media. Each Entry determined by the judges to be a good faith effort will be deemed a completed Entry, and is eligible for consideration towards prizes. Decisions in this matter are in the sole discretion of the judges and shall be final and binding. In selecting the Spotlight Entries, judges will consider the quality of writing, the quality of research sources and other intangible attributes, as the judges in their sole discretion decide to consider. The judges intend to choose Spotlight Entries from a broad range of schools, in terms of size, geographic location and other attributes and from a broad range of topics. Entries that discuss events that are not the subject of many other submissions are more likely to be chosen as Spotlight Articles than Entries about more commonly submitted historical events.

9. GRAND PRIZE: All accounts on findingEducation that submit Entries during the Challenge Period shall be eligible for a random drawing, to be held on or after May 16, 2011. The school (or parent of a home schooled child) of the winning account shall receive a prize of a check for U.S. $500.00 (Five Hundred Dollars).

10. MONTHLY PRIZES: All accounts on findingEducation that submit Entries during any calendar month during the Challenge Period, commencing with October 2010, shall be eligible for a random drawing, to be held on or after the last day of the calendar month. The teacher or other educator who creates the winning account shall receive a prize of a gift card from a retailer (to be chosen by Sponsor) with a face value of $50.00 (Fifty Dollars).

11. SPOTLIGHT PRIZES: Each month, the judges shall choose one or more Entries to be spotlighted on the blog of findingEducation as an exemplar for other Entries. The student author(s) of such entries shall receive a gift or gift card with a value of approximately U.S. $20.00 (Twenty Dollars) and other recognition. In addition, the Sponsor shall from time to time select Entries to be featured on findingDulcinea.

12. TAXES: All winners are subject to pay any appropriate taxes.

13. GENERAL CONDITIONS: Prizes are awarded without warranty of any kind from the Sponsors, express or implied, without limitation, except where this would be contrary to federal, state or local laws or regulations. All federal, state and local laws and regulations apply. Submission of an Entry in this Challenge constitutes agreement by the Participant to the terms and conditions of these Rules. Decisions of the Sponsors and the Judges are final and binding on all matters pertaining to this Challenge.

14. WARRANTY: Each Participant represents and warrants to the Sponsors as follows: (i) the written Entry is the Participant’s own original, previously unpublished and previously unproduced work; (ii) the written Entry submission neither infringes upon nor violates the intellectual property rights or other rights of any other person or entity; and (iii) the written Entry submission does not and will not violate any applicable laws, and complies with these Challenge Rules.

15. DISQUALIFICATION: Any false information provided within the context of the Challenge by any Participant concerning identity, mailing address, telephone number, e-mail address, ownership of right or non-compliance with these Official Rules or the like may result in the immediate disqualification from the Challenge. DM further reserves the right to disqualify any Entry that it believes in its sole discretion infringes upon or violates the rights of any third party, or otherwise does not comply with these Challenge Rules.

16. ARBITRATION: By entering the Challenge, each Participant agrees that exclusive jurisdiction for any dispute, claim or demand related in any way to the Challenge will be decided by binding arbitration. You agree that the exclusive venue for any dispute between you and the Sponsors of whatsoever kind or nature arising out of these Rules or the Challenge shall be Brooklyn, N.Y.

17. WINNERS LIST: A list of winners will appear after June 1, 2011, on http://findingEducation.com

18. Sponsor is not responsible for late or misdirected entries or technical malfunctions and may suspend, modify or terminate the Challenge in the latter event. In the event of early termination, judging and selection of winners will take place using eligible entries received prior to termination.

19. You agree that submission of an Entry grants DM the exclusive right to publish, edit and/or copy the entry for any and all purposes in any media (including but not limited to print and digital media) without further compensation to the entrant.

20. Each winner will be required to comply with all instructions in the prize notification letter and may be required to sign an affidavit of eligibility, a liability release and a publicity release (where permitted by law). If the completed signed forms are not received within 14 days of the date printed on the notification, prize may be forfeited and the entrant with the next highest ranked entry will be selected as the alternate winner.

21. No substitutions or transfers of prizes by the winners will be allowed. DM may substitute a prize of equal or greater value, in its sole discretion.
